Kiwi Dials Squawk Metrics, Inc. — a Washington corporation Effective date: April 14, 2026


1. Who we are and what this is

Kiwi Dials is an engagement measurement tool made by Squawk Metrics, Inc. ("Squawk Metrics," "we," "us"). These Terms of Use govern your access to and use of Kiwi Dials, including the web portal and any related services (collectively, "the Service").

By creating an account, you agree to these terms. If you do not agree, do not use the Service.


2. Eligibility

You must be at least 13 years old to use Kiwi Dials. By creating an account, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms on your behalf.


3. Your account

You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us promptly at support@kiwidials.com if you believe your account has been compromised.

One person, one account is the norm. The Service supports multiple accounts on a single device for legitimate purposes — for example, separating personal and work use — but you may not use multiple accounts to circumvent restrictions or misrepresent your identity.


4. What the Service does

Kiwi Dials lets individuals and groups measure engagement across a set of structured dimensions called dials. Depending on how you use the Service:

  • Solo use: You submit responses on dials and see your own scores over time. No other person sees your data.
  • Shared use (dyad or small group): You and one or more people you have invited share aggregated scores. On small groups, technical anonymity is limited — see Section 6.
  • Team use: Larger groups see aggregated scores across the team. Individual responses are not attributed to individuals in any display.

5. Invitations and team membership

You may invite others to join a team or shared group. By sending an invitation, you represent that you have a legitimate reason to contact the recipient and that you will not use the invitation system to spam or harass. We enforce rate limits and may suspend accounts that generate unusual decline or block rates.

Recipients control their own acceptance. You cannot compel someone to join.


6. Anonymity — honest disclosure

We take anonymity seriously, and we want to be honest about its limits.

On larger teams (roughly nine or more members): Aggregate scores are meaningfully anonymous. No individual response is identifiable.

On small groups (fewer than nine members): Anonymity is aspirational, not guaranteed. If only a small number of people respond, the range of plausible contributors is narrow. We design the Service to protect privacy, but we cannot make mathematical guarantees at small group sizes. You should be aware of this before joining or creating a small group.

On solo use or shared dyad use: There is no anonymity in the traditional sense — you are the only person whose data is in scope.

Scores are always aggregate. We do not display individual responses to any other user, regardless of group size.


7. Your data

What we collect: To operate the Service, we collect your email address, display name, responses you submit, and team membership information. We also collect standard usage and device data to operate and improve the Service. Our Privacy Policy describes this in detail.

How we use it: We use your data to operate the Service, send you notifications you have requested, and improve the product. We do not sell your personal data to third parties. We do not use your responses or engagement data for advertising.

Retention: Responses and scores are stored indefinitely to support longitudinal tracking, which is central to the Service's value. If you delete your account, your personal data is removed from active systems within a reasonable period, subject to legal retention obligations. Historical aggregate scores may be retained in de-identified form.

Your rights: Depending on where you live, you may have rights to access, correct, delete, or export your personal data. See our Privacy Policy or contact us at privacy@kiwidials.com to make a request.


8. GDPR and international users

Kiwi Dials is operated from Washington State, United States. If you access the Service from outside the United States, your data will be transferred to and processed in the US.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) and equivalent laws, including the right to access your data, request correction or deletion, object to processing, and lodge a complaint with your local supervisory authority. We process your data on the basis of your consent (given at account creation) and, where applicable, our legitimate interests in operating and improving the Service.

We do not currently have a formal EU representative or Data Processing Agreement in place. If this is a requirement for your organization's use of the Service, please contact us at privacy@kiwidials.com before creating an account.


9. Acceptable use

You agree not to:

  • Use the Service to harass, intimidate, or harm any person
  • Attempt to re-identify anonymized data or infer individual responses
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, scrape, or extract data from the Service beyond normal use
  • Use the Service in violation of any applicable law

We may suspend or terminate accounts that violate these terms.


10. Content you provide

By submitting content to the Service — including responses, team names, and other inputs — you grant Squawk Metrics a license to store, process, and display it as necessary to operate the Service.

Content you contribute to a shared team becomes part of that team's record. Team names and anonymized response history remain associated with the team if you leave or delete your account; they are not portable with you individually. This is described in more detail in our Privacy Policy.

We do not use your content for advertising and do not sell it to third parties.


11. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these terms, with or without notice depending on the severity of the violation.

On termination, your right to use the Service ends. Provisions that by their nature survive termination — including sections on data retention, limitation of liability, and governing law — remain in effect.


12. Disclaimer of warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, about the Service's reliability, accuracy, or fitness for any particular purpose. We do not warrant that the Service will be uninterrupted or error-free.


13. Limitation of liability

To the fullest extent permitted by law, Squawk Metrics will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these terms or your use of the Service will not exceed the amount you paid us in the twelve months before the claim arose, or $100, whichever is greater.

Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted by local law.


14. Governing law and disputes

These terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Any dispute arising from these terms or the Service will be resolved in the state or federal courts located in Skagit County, Washington, and you consent to personal jurisdiction there.

If you are located in the EU, UK, or another jurisdiction that does not permit mandatory foreign forum selection, nothing in this section prevents you from bringing claims in your local courts or before your local supervisory authority.


15. Changes to these terms

We may update these terms from time to time. When we do, we will update the effective date at the top of this page and notify you through the Service or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated terms.
